Gina Ricci wants to clarify that our service is to offer you the best quality products and customer service so you enjoy our products and continue online shopping with us. By placing an order we understand that you have read and agreed to our Terms and Conditions, therefore entering into a legal contract with us. Please remember that these Terms & Conditions may be subject to change without notice every now and then, we recommend that you read them each time you place an order. Pricing policy/availability of goods

The prices are inclusive of VAT at the appropriate rate where applicable. If your delivery address is outside the UK, there may be import duties and taxes levied when the shipment reaches your country. Any such additional charges must be paid by you. Customs policies and practices vary widely from country to country so we recommend that you contact your local customs office for information on policies in the country relevant to you. We monitor our prices and information carefully; however prices and availability of goods may be subject to change without notice. We reserve the right to withdraw or amend the details and price of a product at any time. We will not be liable to you or any third party due to any changes as noted above whether or not that product has been sold.

Basis of the sale

We shall sell to you and you shall purchase only those goods which you have set out in an order and which have been accepted by us. We reserve the right to reject any order. Unless otherwise agreed in writing each such sale of Goods will be subject to these terms and conditions.

No order submitted by you shall be deemed to be accepted by us unless and until confirmed by e-mail or in writing by us.

No variation to these Conditions shall be binding upon us unless and until agreed by e-mail or in writing by us.

Any error or omission in any information or document issued by us shall be subject to correction provided that the correction does not materially affect the contract.

Time limit for notifications of claims

You are asked to examine the goods as soon as reasonably possible after delivery. Any claim by you based on any defect in the quality or condition of the Goods or their failure to correspond with specification must (whether or not delivery is refused by you) be notified to the company within 14 days from the date of delivery or within a reasonable time after discovery of the defect or failure if it was not apparent on reasonable inspection.

Where a valid claim in respect of Goods delivered is notified to us within 14 days of the delivery date, or within a reasonable time if not apparent on reasonable inspection, you are entitled to:

i) reject the Goods and receive a full refund;

ii) or have the Goods (or the part in question) replaced free of charge.

Any claims made after 14 days of delivery or exceeding a reasonable time of discovery, we shall be entitled to either:

i) replace the Goods (or the part in question) free of charge or

ii) at our sole discretion refund to you the price of the Goods (or a proportionate part of the price) and we shall have no further liability to you.

Except in respect of death or personal injury caused by our negligence we will not be liable under this contract for any loss or damage caused by us or our agents in circumstances where:

i) there is no breach of a legal duty of care owed to you by us or by any of our employees or agents;

ii)such loss or damage is not a reasonably foreseeable result of any such breach;

ii) such loss or damage is not a reasonably foreseeable result of any such breach;

iii)increase in loss or damage resulting from breach by you of any term of this contract.

In the event that you are using the supply address in part for commercial purposes then no liability for loss of profits or other economic loss arising out of a breach of this agreement can be accepted.

Subject to our obligations, and your rights under the Regulations, we shall not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the Goods if the delay or failure was due to any cause beyond our reasonable control. We assume no responsibility for the contents of any other web sites to which this Web Site has links.

The Royal Mail Delivery Service

If no-one is available to accept the delivery and it will not fit through your letterbox a card should be left to advise where the parcel is, it may be left with a neighbour or returned to the depot. The card will give the option to either have the parcel redelivered or advise where it can be collected from. If no action is taken after 18 days the parcel will be returned to us. Whilst Royal Mail usually arrive within 1-5 days, Royal Mail stipulate that only items still not delivered after 15 working days can be officially classified as lost. Please allow 10 working days after the expected arrival date of your order before contacting us. Please enter any additional delivery instructions in the box provided once you click the checkout button.

Delivery options by Royal Mail include all UK postcodes in England, Wales, Northern Ireland and mainland Scotland and the Highlands. Scottish Islands may be subject to additional delivery time.

Our next day delivery option is only available from Monday to Friday excluding bank holidays and as long as the order is placed before 4pm. 

International Signed For delivery service is automatically selected when purchasing goods outside of the UK, this means the Royal Mail provides an end to end tracking service ensuring your product arrives safely. However please note some countries do not have an end to end delivery service which means the product will only be tracked up until the moment it leaves the UK only.

Returns

You may return goods within 14 days and we will replace, exchange or provide a full refund. Please note the items you return have to be resold, so we ask you to wrap and cover the package the same as it was sent out to you. For all returns you will be required to arrange and fund the return of the goods to us. You are responsible for ensuring the product is safely returned to us, we suggest that you use a secure delivery method that requires a signature upon receipt and provides you with a proof of posting as we cannot be held responsible for losses or damage in transit.

In order for us to deal with your return efficiently please enclose and state CLEARLY full contact details and advise us whether you require a replacement, refund or an exchange. This does not affect your statutory rights.

Please note: When trying on shoes / boots / welly’s from Gina Ricci please remain indoors, preferably on carpet as we cannot accept goods for refund if they have been damaged or soiled during trying on. The same applies to any other product, if they have been obviously used / worn longer than a quick ‘try on’ period and are damaged / over worn then we will not accept the refund.

Order cancelation and ownership

You may cancel your order for any reason provided that you notify us in writing (fax or email is acceptable) no longer than 14 working days after the day you receive your order. If your order has been despatched you will be required to return the order to us and you will be responsible for the cost. We suggest that you use a secure delivery method that requires a signature upon receipt and provides you with a proof of posting. Upon receipt of the returned goods a refund, including the original delivery charge, will be credited within 30 days to the facility used to place the order. To cancel your orders please contact us via email or telephone. You will become the owner of the goods you have ordered once they have been delivered to you and they will be held at your own risk. You have a statutory duty to take reasonable care of goods whilst held in your possession and until such time as returned goods are received by us. Please ensure that any goods being returned are packaged appropriately. We will not be liable for any loss or destruction of goods, once delivered to you. None of these terms and conditions affects your statutory rights as a consumer.
